Medicare and Medicaid Programs; Reform of Requirements for Long-Term Care Facilities

CMS published the Reform of Requirements for Long-Term Care Facilities final rule on October 4, 2016. This final rule will revise the requirements that Long-Term Care facilities must meet to participate in the Medicare and Medicaid programs. These changes are necessary to reflect the substantial advances that have been made over the past several years in the theory and practice of service delivery and safety. These revisions are also an integral part of CMS’ efforts to achieve broad-based improvements both in the quality of health care furnished through federal programs, and in patient safety, while at the same time reducing procedural burdens on providers.

Of Note: Freedom From Abuse, Neglect, and Exploitation (§ 483.12). CMS is requiring facilities to investigate and report all allegations of abusive conduct. CMS is also specifying that facilities cannot employ individuals who have had a disciplinary action taken against their professional license by a state licensure body as a result of a finding of abuse, neglect, mistreatment of residents or misappropriation of their property.

CMS published the Emergency Preparedness Requirements for Medicare and Medicaid Participating Providers and Suppliers final rule on September 16, 2016. This final rule establishes national emergency preparedness requirements for Medicare- and Medicaid-participating providers and suppliers to plan adequately for both natural and man-made disasters, and coordinate with federal, state, tribal, regional, and local emergency preparedness systems. It will also assist providers and suppliers to adequately prepare to meet the needs of patients, residents, clients, and participants during disasters and emergency situations.

The Department of Health and Human Services, Administration for Children and Families, proposes to amend the Child Care and Development Fund (CCDF) regulations. This proposed rule makes changes to CCDF regulations to detail provisions of the Child Care and Development Block Grant Act of 2014 in order to protect the health and safety of children in child care; help parents make informed consumer choices and access information to support child development; provide equal access to stable, high quality child care for low-income children; and enhance the overall quality of child care and the early childhood workforce.

VA Proposed Rule - Ensuring a Safe Environment for Community Residential Care Residents

The VA is proposing to prohibit community residential care facilities (CRCs) — medical foster homes, assisted living homes, group living homes, family care homes, psychiatrics CRCs homes — from “employing an individual who have been convicted in a court of law of certain listed crimes against a person or property, or has had a finding entered into an applicable State registry or with the applicable licensing authority concerning abuse, neglect, mistreatment or individuals or misappropriation of property.” The VA believes that 75 percent of CRCs could obtain background checks from existing federal or State programs such as the NBCP.
